The Boring Bit!
I’ve tried to keep these terms and conditions short and in plain English to avoid misunderstandings and provide clarification should any dispute arise. In order to start working with you on your project, I need you to confirm that you have read and agreed to these terms.

The relationship between Up write (me/I) and the client (you) will be that of ‘independent contractor’, which means that I am not your employee, worker, agent or partner, and I will not give the impression that I am. My time will therefore be limited to the project at hand, including any consultation time warranted by the project.
Our current copywriting fees are priced per product and will be agreed before work commences. Before each project, I will provide a quote so that you know exactly how much the work will cost. Any changes to the original brief requested by you may require me to adjust the cost. The total price of your project will include:
- A free quote
- A maximum of 2 drafts of the project specified in the original brief
Any additional work requested that isn’t covered in the original brief will be quoted and invoiced separately.
My data capture form will be completed by you and should clearly outline the project requirements. I require you to complete and return the data capture form I provide to ensure that I have all the necessary information beforehand. The data capture enables you to provide any and all information you feel pertinent.
Timescale and Deadlines
I will make every effort to ensure your project is delivered on time. In the unlikely event that I cannot meet the agreed deadline, I will let you know as soon as possible. I will not be held liable for any loss or damages to any party as a result of missing a deadline.
Before your project is undertaken, I require payment in advance and a confirmation email, stating that you have read and agree to my terms and conditions.
I require the project to be paid in full before commencement of work.
In the unlikely event that you are unhappy or dissatisfied with my work in anyway I will always do my best to remedy or rectify the situation. I provide all services to the best of my abilities and it is important to me that my clients are happy with the work I produce. All clients are given the opportunity to provide feedback and I will always provide a second draft if edits are requested. For ongoing social media work it is the clients responsibility to stay in touch and offer regular feedback so the content may be adjusted or altered.
You have no right to demand a refund based on your critical response to, or appraisal of, the copy I write for you. You are paying for my time, quantum meruit. This includes time I put aside to make revisions in expectation of feedback. All invoices are sent electronically, unless agreed otherwise and are payable within 7 days of receipt.
I accept payments by BACS or PayPal but unfortunately I do not accept cheques.
International Payment Fees (PayPal)
International clients are expected to cover any additional currency conversion charges to the service provider (Up write).
PayPal fees are currently charged thus:
International payment fee + fully funded payment fee + fixed fee + cross border fee + currency conversion fee.
(Exact amounts are subject to the amount in question and the country of origin of the sender).

Please note that international clients may also be subject to their own transaction fees for sending money overseas by PayPal.
If a client fails to respond to communication within 30 days of submission of data capture form, the project will terminate automatically.
Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, zombie apocalypse, fire, the act or omission of government, highway authorities or any telecommunications carrier, operator or administration or other competent authority, or the delay or failure in manufacture, production, or supply by third parties of equipment or services, and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.
I occasionally work alongside other copywriters. In such cases, all work produced will be under the banner of ‘Up write’. I will be the client point of contact and agree/oversee the scope of the project while acting as editor and proofreader.
Intellectual Property Rights
Upon completion of the project, all copyrights are automatically transferred to you. I reserve the right to use any extracts of my work for my portfolio. Similarly, if we’ve worked alongside a subcontracted copywriter (as advised by me), they will also have the right to use any extracts of their work on their portfolio and marketing materials unless otherwise agreed beforehand.
Whilst we make every effort not to breach any copyright, you agree to indemnify us against action that may arise as a result of using our services.
Errors and Omissions
I make every effort to ensure that the project is proofread, grammatically accurate and factually referenced where applicable. However, I cannot guarantee that every project is completely free from typographical, grammatical or factual errors.
By using our services, you agree to indemnify me against any claim, including that of a third party, for compensation or damages resulting from the use of my written material or from unsought permissions to use my material.
Although every piece of written content I produce is original, you accept full responsibility for checking the authenticity of the project, including research materials and citations supplied and indemnify me of any compensation for loss or damages.
